- ENERAL PROVISIONS
- The online store at https://inarms.pl is operated by INFOV Sp. z o.o., a limited liability company registered in the Business Register maintained by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division of the National Court Register, KRS No.: 0000621574, NIP: 7123313875, REGON: 364635788, with its registered office at Aleja Krakowska 9, 05-090 Sękocin Nowy, Poland, email address: info@infov.eu, tel.: +48 22 290 49 05.
- The https://inarms.pl store operates in accordance with the terms and conditions set forth in these Terms of Service.
- These Terms and Conditions define the types and scope of services provided electronically by the https://inarms.pl, Store, the rules governing the provision of such services, the terms and conditions for entering into and terminating contracts for the provision of electronic services and Product Sales Agreements, as well as the complaint procedure.
- Upon taking steps to use the electronic services of the https://inarms.pl online store, each Customer is required to comply with the provisions of these Terms and Conditions..
- In order to place an Order in the Store, the Customer must read the Terms and Conditions and accept their provisions at the time of placing the Order.
- The https://inarms.pl store sells products both retail and wholesale online in Poland and other European Union countries.
- The store also sells special and licensed products in-store—including firearms, ammunition, essential firearm components, optical equipment, night vision and thermal imaging equipment, sights, mounts, and tactical and hunting accessories—in accordance with applicable laws, in particular:
- the Act of May 21, 1999, on Weapons and Ammunition (Journal of Laws 2020, Item 955, as amended),
- the Act of June 13, 2019, on the conduct of business activities involving the manufacture and trade of explosives, weapons, ammunition, and products and technology intended for military or police use (Journal of Laws 2019, Item 1214, as amended),
- and the relevant implementing regulations.
- The sale of licensed products (in particular firearms, ammunition, and essential firearm components) is available exclusively for in-person pickup at the Seller’s physical store, upon the Customer’s presentation of the appropriate permits, certificates, or identification authorizing the purchase of the product.
- Licensed products are not shipped via courier services, the postal service, or public transportation. Pickup is permitted only after in-person identity verification and confirmation of the customer’s eligibility under the Act of May 21, 1999, on Weapons and Ammunition.
- The https://inarms.pl store does not ship outside of Poland any products from its selection whose purchase and delivery by mail are prohibited or restricted by law.
Liability and Legal Limitations
- The store would like to inform you that different countries may have separate laws regarding the possession, use, and purchase of products such as:
- uncooled thermal imaging modules , night vision and
- thermal imaging devices , digital optical systems, day and
- night sights,
- firearms and ammunition for such weapons,
- mounting accessories and tactical gear.
- If you place an order from outside Poland or travel abroad with a product purchased from the Store, you are solely responsible for ensuring that the possession and use of the product comply with the laws of the destination country.
- The store is not liable for any consequences resulting from a lack of knowledge of applicable local laws, particularly those prohibiting the import or possession of weapons, ammunition, or military-grade optoelectronic devices in the customer’s destination country.
Product Information
- The products offered in the Store have the appropriate manufacturer’s certificates, are new, free from defects, comply with the terms of the agreement, and have been legally placed on the Polish market.
- Some of the products offered in the Store may come from military warehouses or reserve stocks of uniformed services and have never been used. Customers have the same rights with respect to these products as they do with new products.
- All trade names, product names, company names, and logos used on the website https://inarms.pl belong to their respective owners and are used solely for identification purposes. They may constitute registered trademarks.
- All materials, descriptions, and photos presented on the Store’s website are for informational and illustrative purposes only. The actual appearance of the product may differ slightly from that shown in the photos, which does not constitute a breach of contract.
Legal basis

- the Act of April 23, 1964 – Civil Code (Journal of Laws No. 16, item 93, as amended),
- the Act of May 21, 1999, on Weapons and Ammunition,
- the Act of June 13, 2019, on the conduct of business activities involving the manufacture and trade of explosives, weapons, ammunition, and products and technology intended for military or police use,
- and other relevant provisions of Polish law.
- DEFINITIONS
CHAT – an electronic service provided by the Service Provider to Service Users, enabling conversations between currently logged-in Service Users and the Service Provider’s representatives.
WORKING DAY – any day from Monday through Friday, excluding public holidays.
CONTACT FORM – a form available on the website https://inarms.pl that allows you to send a message to the Service Provider.
REGISTRATION FORM – a form available on the website https://inarms.pl that allows you to create an account.
ORDER FORM – a form available on the website https://inarms.pl that allows you to place an order.
CONSUMER – a natural person who enters into a legal transaction with a business entity that is not directly related to their business or professional activities.
ENTREPRENEUR – a natural person, a legal entity, or an organizational unit that is not a legal entity but is granted legal capacity by law, conducting business or professional activities in its own name.
CUSTOMER – A customer who intends to enter into or has entered into a Sales Agreement with the Seller.
ACCOUNT – a collection of resources within the Service Provider’s IT system, identified by a unique username (login) and password, in which the Service Recipient’s data is stored, including information about Orders placed.
TERMS AND CONDITIONS – these Terms and Conditions of the Store.
STORE – the Service Provider’s online store at https://inarms.pl and its associated brick-and-mortar retail locations operated by INFOV Sp. z o.o.
SELLER / SERVICE PROVIDER – INFOV Sp. z o.o., KRS No.: 0000621574, NIP: 7123313875, REGON: 364635788, Aleja Krakowska 9, 05-090 Sękocin Nowy, Poland.
FEEDBACK SYSTEM – an electronic service provided to Customers by the Service Provider, enabling them to post feedback regarding the progress and completion of transactions.
PRODUCT – a tangible item or service available in the Store that is the subject of a Sales Agreement between the Customer and the Seller.
LICENSED PRODUCT – a product whose sale, possession, or distribution requires a permit, license, or other applicable authorization, in particular firearms, ammunition, essential firearm components, night-vision devices, thermal imaging devices, or other goods intended for military or police use.
WEAPONS AND AMMUNITION – products whose sale and purchase are regulated by the Act of May 21, 1999, on Weapons and Ammunition, and the Act of June 13, 2019, on the Conduct of Business Activities Involving the Manufacture and Trade of Explosives, Weapons, Ammunition, and Products and Technology for Military or Police Use.
DOCUMENT AUTHORIZING PURCHASE – a permit, certificate, official ID, or other document issued by the competent authority confirming the Customer’s right to purchase a specific type of licensed product.
PICKUP – a method of Product delivery whereby the Customer personally picks up the Product at the Seller’s physical retail location, following the placement of an Order online or by phone and verification of the relevant documents authorizing the purchase; this method is required, in particular, for the sale of firearms, ammunition, or other licensed products.
SALES AGREEMENT – a sales agreement for a Product entered into between the Customer and the Seller through the Store or at the Seller’s physical location.
SERVICE USER – a natural person, a legal entity, or an organizational unit without legal personality to which the law grants legal capacity, using the Electronic Service.
ELECTRONIC SERVICE – a service provided electronically by the Service Provider to the Customer through the Store.
ORDER – a declaration of intent by the Customer constituting an offer to enter into a Product Sales Agreement with the Seller.
NEWSLETTER – An electronic service that allows the Subscriber to subscribe to and receive, at the email address provided by the Subscriber, free information from the Service Provider regarding the Products available in the Store.
PRICE – the amount, expressed in monetary units, that the Customer is required to pay to the Seller for the Product.
III. TYPE AND SCOPE OF ELECTRONIC SERVICES
- Through the Store, the Service Provider offers the following Electronic Services:
a) entering into Product Sales Agreements,
b) maintaining an Account in the Store,
c) the Newsletter,
d) Chat,
e) posting reviews,
f) the Contact Form. - The provision of electronic services to customers in the Store is governed by the terms and conditions set forth in these Terms and Conditions.
- Electronic Services are provided free of charge for an indefinite period, except in cases where their use is part of the performance of the Sales Agreement.
Services related to licensed products
- With regard to licensed products, in particular weapons, ammunition, essential weapon components, and goods intended for military or police use, the Service Provider restricts certain features of the Store, including:
- I t is not possible to complete the purchase without in-person verification of the relevant documents;
- there are no online payment or delivery options (purchases can only be made with in-person pickup);
- there is no automatic confirmation of the conclusion of the Sales Agreement prior to verification of the Customer’s eligibility under the Act of May 21, 1999, on Weapons and Ammunition.
- An online order for a licensed product constitutes only a reservation of the goods. The Sales Agreement is concluded after the Customer appears in person at the Seller’s point of sale, presents a document authorizing the purchase in accordance with the Act of May 21, 1991, on Weapons and Ammunition, and confirms their identity using an ID card.
- The Service Provider hereby states that the Electronic Services do not include the transmission or storage of copies of documents authorizing the purchase of firearms or ammunition via electronic means. Such data is verified and archived exclusively in paper form in accordance with applicable laws.
Communication and Safety
- The Service Provider offers the option to contact Store representatives via Chat, the Contact Form, or email.
Communication conducted through these channels does not constitute an official means of entering into a contract for the purchase of firearms, ammunition, or other licensed products. - The Service Provider does not allow users to submit identification documents, permits, or sensitive information regarding firearm ownership rights via Chat or Forms.
- All inquiries regarding licensed products, firearms, and ammunition are handled exclusively by authorized employees who have received the appropriate training and authorization.
Promotional content
- The Service Provider has the right to post advertising content on the Store’s website.
This content forms an integral part of the Store and the materials presented therein.
Advertisements for licensed products (firearms and ammunition) are conducted solely to the extent permitted by law and do not constitute a public offer within the meaning of the Firearms and Ammunition Act.
- TERMS AND CONDITIONS FOR THE PROVISION OF AND ENTERING INTO CONTRACTS FOR THE PROVISION OF ELECTRONIC SERVICES
- The provision of the Electronic Services specified in Chapter III, Section 1 of the Terms and Conditions by the Service Provider is free of charge.
- The term of the contract:
(a) The agreement for the provision of an Electronic Service consisting of maintaining an Account in the Store is entered into for an indefinite period,
b) The agreement for the provision of an Electronic Service consisting of enabling the placement of an Order in the Store is concluded for a fixed term and terminates upon the placement of an Order or when the Service Recipient ceases to place Orders,
(c) The contract for the provision of the Electronic Service consisting of the use of the Newsletter is concluded for an indefinite period,
(d) The agreement for the provision of an Electronic Service consisting of the posting of reviews is concluded for a fixed term and terminates upon the posting of a review or upon the Service Recipient ceasing to post reviews,
(e) The agreement for the provision of the Electronic Service consisting of the use of the Chat is concluded for a fixed term and terminates upon the Service Recipient’s cessation of use of the Service,
(f) The agreement for the provision of the Electronic Service, which consists of sending messages via the Contact Form, is concluded for a fixed term and terminates upon the sending of a message or upon the Service Recipient ceasing to send messages.
- Technical requirements necessary for interoperability with the ICT system used by the Service Provider:
- a computer, tablet, or smartphone with Internet access,
- access to email,
- a web browser (we recommend the latest versions of Chrome, Edge, Firefox, or Safari) ,
- and cookies and JavaScript enabled.
- The Customer is required to use the Store in a manner consistent with the law and generally accepted standards of conduct, while respecting the personal rights and intellectual property rights of third parties.
- The customer is required to provide accurate information.
- In particular, the Customer is required to provide a valid and current email address to which the Order can be confirmed.
- The user is prohibited from providing illegal content.
- The Service Provider reserves the right to refuse to publish or to remove reviews whose content may violate the provisions of these Terms and Conditions, generally applicable laws, or the principles of social coexistence, particularly if they contain the following elements:
- generally considered offensive or vulgar; racist or hateful in nature;
- pornographic or erotic in nature;
- constituting criminal offenses or acts of unfair competition;
- infringing on copyrights or
- intellectual property rights;
Special provisions regarding licensed products
- When placing Orders for firearms, ammunition, or licensed products, submitting the Order form in the Store does not constitute the conclusion of a Sales Agreement, but rather a reservation of the goods.
A Sales Agreement is concluded only after the Customer’s identity has been personally verified and the required documents authorizing the purchase, as stipulated by the Act of May 21, 1999, on Weapons and Ammunition, have been presented. - The Service Provider may require additional verification of the Customer’s information before fulfilling the order, including confirmation of:
- the customer’s age,
- possession of the appropriate permit or certificate authorizing the purchase of firearms or ammunition,
- the consistency of personal data with identification documents.
- The service provider does not process or store electronic scans, photos, or copies of documents authorizing the purchase of firearms, ammunition, or licensed products.
Verification takes place exclusively in person at a physical store based on the original documents. - Electronic forms (contact, chat, registration) must not be used to submit sensitive data, copies of permits, ID numbers, or photos of identification documents.
- The Service Provider reserves the right to refuse to provide the Electronic Service or to delete an Account if there is reasonable suspicion that the information provided by the Service Recipient is false, violates the provisions of the Weapons and Ammunition Act, or is used to circumvent regulations governing the trade in licensed products.
- TERMS AND CONDITIONS FOR THE CONCLUSION OF SALES AGREEMENTS
- The information contained on the Store’s website does not constitute an offer under applicable law. By placing an Order, the Customer makes an offer to purchase a specific Product under the terms and conditions set forth in its description.
- The product price displayed on the Store’s website is given in Polish zlotys (PLN) and includes all charges, including VAT. Products delivered outside the European Union may be subject to customs duties or applicable taxes in accordance with the laws of the destination country. For additional information, the Customer is asked to contact the relevant customs or excise authority. The price does not include shipping costs.
- The Store reserves the right to add new products to its selection and to run promotional campaigns on the Store’s website.
- The Product price displayed on the Store’s website is binding at the time the Customer places an Order. This price will not change, regardless of any price changes in the Store that may occur for specific Products after the Customer places an Order.
- The Seller clearly informs Customers about unit prices, promotions, and price reductions on Products. Alongside information about a price reduction on a Product, the Seller displays the lowest price for that Product that was in effect during the 30-day period prior to the reduction; if the Product has been offered for sale for less than 30 days – the Seller displays the lowest price of the Product that was in effect during the period from the date the Product was first offered for sale until the date the price reduction was implemented.
- Products on sale are available in limited quantities, and orders for them will be processed on a first-come, first-served basis until supplies of the product run out.
- To place an Order, the Customer is not required to create an Account on the Store.
- Orders can be placed:
- via the website using the Order Form (https://inarms.pl) – 24 hours a day, year-round;
- via email at info@infov.eu,telefonicznie;
- or by phone at +48 22 290 49 05.
- Orders are processed Monday through Friday. Conclusion
- of the Sales Agreement.
- In order to conclude a Sales Agreement, the Customer must first place an Order using the methods provided by the Seller.
- After an Order is placed, the Seller immediately confirms receipt of the Order and accepts it, thereby binding the Customer to the Order. Confirmation of receipt and acceptance of the Order for fulfillment is provided via an email containing: confirmation of all essential
- elements of the Order,
- a contract withdrawal form, and these Terms and Conditions, which include
- information regarding the right to withdraw from the contract .
- Upon the Customer’s receipt of the email referred to in Section 9(b), a Sales Agreement is concluded between the Customer and the Seller.
- Products subject to specific legal regulations
If an Order is placed for products subject to specific legal provisions, including:
- firearms or their essential components as defined in the Act of May 21, 1999, on Firearms and Ammunition,
- ammunition or its essential components as defined in the Act of May 21, 1999, on Weapons and Ammunition,
- goods and technologies intended for military or police use within the meaning of the Act of June 13, 2019,
on the Conduct of Business Activities Involving the Manufacture and Trade of Explosives, Weapons, Ammunition, and Goods and Technologies Intended for Military or Police Use,
2. The Seller reserves the right to verify the Customer’s eligibility prior to concluding the Sales Agreement.
– The verification includes, in particular: - presentation of a valid firearm permit for the appropriate type of firearm,
- presenting identification,
- in justified cases – providing additional information (e.g., PESEL number, ID card number and series, registered address) necessary to fulfill record-keeping obligations under applicable law.
3. Firearms and ammunition are sold exclusively for in-person pickup at the Seller’s physical store, following prior confirmation of the required permits. The store does not ship firearms or ammunition via courier, mail, or other shipping carriers.
4. The sale of tactical equipment, as well as daytime, thermal, and night vision optics, is conducted in accordance with applicable regulations. If a product is subject to export or usage restrictions (e.g., hunting or military use), the customer will be informed of this in the product description.
5. The right to cancel the contract does not apply to the purchase of firearms and ammunition, due to their special nature and the regulations governing the recording of transactions involving these products.
If the Customer is purchasing the Product as a business, they should indicate this in the Order and provide the required details of the entity to which the relevant VAT invoice is to be issued.
If an Order is placed for Products subject to special legal requirements under the Act of June 13, 2019, on conducting business activities in the field of manufacturing and trading in explosives, weapons, ammunition, and products and technology intended for military or police use, a Store representative will contact the Customer to obtain additional personal data (in particular, the PESEL number, ID card number and series, registered address), necessary to fulfill the Order in accordance with the aforementioned Act.
14. If, during the ordering process, the Customer notices any irregularities in the operation of the order placement mechanism (contract conclusion), in particular incorrect calculations of the value of the ordered Products or shipping costs. The Customer has the right to submit a complaint regarding this matter in writing to the following address: https://inarms.pl, Aleja Krakowska 9, 05-090 Sękocin Nowy, Poland, email address: info@INFOV.eu, tel: +48 22 290 49 05.
15. The Customer will be notified of the outcome of the complaint by phone, in writing, or by email within 7 business days of https://inarms.pl receiving the complaint in question.
16. When placing an Order, the Customer is not required to, but may consent to, the disclosure of the Customer’s email address to Google.com and meta.com for the purpose of sending a one-time request to complete a survey providing feedback on the transaction made in the store, (in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC – GDPR).
VII. COST, DELIVERY DATE, AND DELIVERY METHODS
- The shipping costs for the Product are determined during the Order placement process and depend on the selected payment method and shipping method for the purchased Product.
- Orders placed in the Store by 11:59 p.m. will be shipped on the same business day or the next business day, depending on the shipping method selected by the customer.
- Delivery time: The delivery time for ordered items ranges from 1 business day to a maximum of 14 business days, starting from the date the order is confirmed, depending on product availability and the delivery location. The exact delivery date will be specified in the order confirmation or communicated to the customer.
- In-store pickup: If you choose the in-store pickup option, your order can be ready for pickup the same day if it is placed and paid for by 4:00 PM on a business day and the item is in stock. Otherwise, your order will be ready for pickup on the next available business day.
- Products purchased in the Store are shipped to the Customer via a postal service or courier company to the delivery address specified in the Order Form. If the Customer has chosen in-store pickup, they may pick up their order on the same day or the next business day. The Store is open Monday through Friday from 9:00 AM to 5:00 PM.
- Orders are delivered Monday through Saturday, depending on the shipping method selected by the customer.
- For Orders containing multiple Products with different shipping times, the shipping date for the entire Order is determined by the Product with the longest shipping time.
- Delivery of the Product outside Poland takes place within the timeframe specified by the carrier and, depending on the destination country, takes between 1 and 20 business days.
- The customer has the right to inspect the contents of the shipment in the presence of a carrier representative to verify that the Product has not been damaged during delivery. If you notice any damage to the package or the Product, or if the contents of the package do not match the VAT invoice, please prepare an appropriate report with the courier in accordance with the provisions of transport law and its implementing regulations.
- In cases where delivery cannot be made using the method selected by the Customer, the Seller shall immediately notify the Customer of the need to change the delivery method and offer alternative options.
Products requiring special delivery and receipt conditions
- Products whose sale is subject to specific legal regulations—in particular:
- firearms, their essential components, and ammunition and its essential components,
- goods intended for military or police use,
- Items that require a permit or license —
may not be sent via a postal service, courier company, or any other form of remote delivery.
- Delivery of such Products is available exclusively via in-person pickup at the Seller’s physical store, following prior:
- confirmation that the Customer holds a valid firearms permit for the appropriate type of firearm or another required document under the Act of May 21, 1999, on Firearms and Ammunition,
- presentation of an identity document, and signing of the relevant sales documentation in accordance
- with the Act of May 21, 1999, on Firearms and Ammunition.
- Weapons and ammunition may be picked up in person at the Seller’s premises:
Aleja Krakowska 9, Sękocin Nowy, 05-090, Poland, during the store’s business hours. - If the Customer is unable to pick up the order in person, the order will be held until the buyer’s identity and eligibility have been verified in person.
- The sale of daytime optics, night vision devices, thermal imaging equipment, and tactical gear may be conducted via courier delivery, provided that the products in question are not components of weapons and are not subject to restrictions under separate regulations.
- The seller reserves the right to refuse to ship products abroad that may be subject to export control regulations or regulations governing strategic or licensed trade.
- PRODUCT WARRANTY
- All products offered in the Store are covered by a warranty from the manufacturer, importer, or Seller that is valid within the territory of the Republic of Poland.
- The standard warranty period for Products is 24 months (unless the warranty provider specifies otherwise) and begins on the date the Product is delivered to the Customer or on the date of in-store pickup.
- The specific terms and conditions of the warranty are set forth in the warranty document issued by the warrantor. The documents entitling the holder to warranty coverage are the proof of purchase (invoice or receipt) and, in the case of firearms and ammunition, a document confirming the legal purchase and entry in the firearms and ammunition registry.
- The warranty document issued by the warrantor contains the warrantor’s details, specific information about the goods covered by the warranty, the warranty period and terms, and the rights to which the Customer is entitled under the warranty.
Products subject to special warranty terms
- For licensed products, including:
- For firearms and their essential components, the warranty may be provided for the duration of use or for a specific number of rounds fired, as determined by the manufacturer, and the period during which this number of rounds is fired,
- weapon-mounted optics (daylight, thermal, and night vision sights),
the warranty applies only to unused items that retain all factory markings and seals.
- The warranty does not cover:
- damage resulting from improper use of the firearm or ammunition, t
- hird-party tampering with the firearm’s design, installation of accessories in a manner inconsistent with the instructions,
- normal wear and tear (e.g., springs, gaskets, barrels, protective coatings), or
- damage resulting from modifications or technical tuning.
- Products subject to registration requirements (firearms, ammunition) may not be sent for warranty service or repair without first contacting the Seller and agreeing on a method of delivery that complies with the provisions of the Firearms and Ammunition Act.
- Warranty repairs on firearms may only be performed by the manufacturer’s authorized gunsmith service or by a licensed gunsmith designated by the Seller.
- For optical, night vision, thermal imaging, and tactical equipment, the Seller acts as an intermediary in warranty service in accordance with the terms and conditions set forth by the manufacturer of the respective device.
- This warranty does not exclude, limit, or suspend the rights of the Consumer or of a business acting as a consumer arising from the Product’s non-conformity with the Sales Agreement, as set forth in the Consumer Rights Act.
- COMPLAINT PROCEDURE:
- Complaint regarding the Product’s non-conformity with the contract.
- The basis and scope of the Seller’s liability toward a Customer who is a Consumer or a business entity with consumer rights, arising from the Product’s lack of conformity with the contract, are set forth in the Consumer Rights Act of May 30, 2014,
- The basis and scope of the Seller’s liability to a Customer who is an entrepreneur, as referred to in Chapter XIII, under the warranty are set forth in the Civil Code of April 23, 1964,
- The Seller is liable to the Customer—whether a Consumer or a business acting as a consumer—for any lack of conformity of the Product with the contract that existed at the time of delivery and becomes apparent within two years of that time, unless the Product’s shelf life, as specified by the Seller or persons acting on its behalf, is longer.
- If you wish to file a complaint, please contact the INFOV office.
- Notifications regarding defects in the Product and related claims may be submitted via email to: info@INFOV.eu or in writing to: Aleja Krakowska 9, 05-090 Sękocin Nowy, Poland.
- In the messages above, please provide as much information and detail as possible regarding the subject of the complaint, including, in particular, the nature and date of the issue, as well as your contact information. The information you provide will significantly facilitate and expedite the Seller’s review of the complaint.
- In order to assess any defects or non-conformities of the Product with the contract, the Consumer or a business acting as a consumer is required to make the Product available to the Seller, and the Seller is obligated to collect it at its own expense.
- A licensed product subject to the Act of May 21, 1999, on Weapons and Ammunition must be delivered by the Customer or a business acting as a consumer to the headquarters of INFOV Sp. z o.o. or to an address specified by the Seller.
- The Seller will respond to the Customer’s request immediately, no later than within 14 days. The response to the complaint will be sent on a durable medium, specifically to the email address provided by the Customer or by any other method specified by the Customer.
- In the case of a complaint filed by a Customer who is a Consumer, failure to address the complaint within 14 days shall be deemed to constitute acceptance of the complaint.
- In response to a valid complaint from a Customer who is a Consumer or a business entity with consumer rights, the Seller shall, as appropriate:
- covers the costs of replacing and reshipping the Product to the Consumer,
- covers the costs of repairing and reshipping the Product to the Consumer,
- reduces the price of the Product (the reduced price must be proportional to the price of the conforming goods relative to the non-conforming goods) and reimburses the Consumer or a business acting as a consumer for the amount of the price reduction no later than 14 days after receiving the Consumer’s or the business’s statement requesting the price reduction,
- In the event of a valid withdrawal from the contract by the Consumer or a business acting as a consumer, the Seller shall refund the price of the Product no later than 14 days from the date of receipt of the returned goods from the customer or proof of their return. In the event of withdrawal from the contract referred to in this section, the Consumer or a business acting as a consumer is obligated to return the goods to the Seller immediately at the Seller’s expense.
- Complaints regarding goods by businesses without consumer rights
1. businesses organized as general partnerships, limited partnerships, or limited liability companies,
2. foundations or associations that purchase goods,
3. businesses for which the purchase is made for professional purposes - For complaints regarding goods purchased by a business owner for the company, the warranty, the guarantee, or the general principles of contractual liability may apply.
- Warranty for Business Customers
A defect consists of the non-conformity of the sold item with the contract. In particular, the sold item is non-conforming to the contract if:
1. it lacks the characteristics that an item of this type should have in view of the purpose specified in the contract or arising from the circumstances or intended use;
2. it lacks the characteristics the seller assured the buyer of, including by presenting a sample or model;
3. it is not fit for the purpose the buyer informed the seller of at the time of concluding the contract, and the seller did not raise any objections regarding such intended use;
- Repairs under warranty for those Products which, under Polish law, cannot be shipped and were purchased at the INFOV Sp. z o.o. headquarters or at one of the stores partnering with the Seller, are possible only if the Product is personally delivered to the service center at the company’s headquarters or to one of the aforementioned partner stores.
- The Seller will store any unclaimed items for a period of 3 months from the date the complaint process is finalized. After this period, the Seller will notify the customer to pick up the goods. If 14 days have passed since the notification, the Seller reserves the right to take action regarding the non-contractual storage of the goods.
- The customer is required to return Products under the complaint process in a condition that allows for their safe inspection. Therefore, all devices must be returned with the battery or rechargeable battery removed (batteries and rechargeable batteries must be stored separately from the device) in accordance with safety regulations.
- The firearms are to be delivered unloaded and in their entirety, without any additional equipment.
- In the event that the life or health of the Store’s employees is endangered, we reserve the right to seek compensation. In cases involving violations of applicable law, the Store will notify the relevant authorities of the situation.
- Complaints regarding the provision of Electronic Services by the Service Provider:
- The Customer may submit complaints regarding the provision of Electronic Services through the Store via email to the following address: info@INFOV.eu
- In the email above, please provide as much information and detail as possible regarding the subject of the complaint, including the nature and date of the issue, as well as your contact information. The information you provide will significantly facilitate and expedite the Service Provider’s review of your complaint.
- The Service Provider will review the complaint immediately, no later than within 14 days.
- The Service Provider’s response to the complaint is sent to the email address provided by the Customer in the complaint form or via another method specified by the Customer.
- Complaints regarding firearms, ammunition, and licensed products
- In the case of Products whose sale and distribution are subject to specific legal provisions, including:
- firearms and their essential components,
- ammunition for firearms and their essential components
- military or police equipment,
complaints may be submitted only in writing or by email, in accordance with the security procedures set forth in the Weapons and Ammunition Act.
- Due to the requirement to keep records of firearms and ammunition:
- These products may not be sent to the Seller as part of a return or complaint via courier services or postal carriers,
- Products submitted for a warranty claim or repair must be brought in person, upon presentation of a valid ID and a firearm permit for the appropriate type of weapon.
5. The Seller or an authorized gunsmith service designated by the Seller will assess the validity of the claim in the Customer’s presence.
6. If the complaint cannot be accepted or the product cannot be repaired, the Seller will inform the Customer of the next steps in accordance with the provisions of the Weapons and Ammunition Act.
7. The return or exchange of weapons and ammunition may only take place within the scope provided for by law—a simple return due to withdrawal from the contract is not possible.
- RIGHT OF WITHDRAWAL
- Subject to Section 9 of this chapter, a Customer who is also a Consumer and who has entered into a distance contract may withdraw from it without giving any reason by submitting a written notice of withdrawal within 14 days. To meet this deadline, it is sufficient to send the notice of withdrawal.
- In the event of withdrawal from the contract, the Sales Agreement is deemed not to have been concluded, and the Consumer is required to return the Product to the Seller or hand it over to a person authorized by the Seller to collect it without delay, but no later than 14 days from the date on which the Consumer withdrew from the contract, unless the Seller has offered to collect the Product themselves. To meet the deadline, it is sufficient to send the Product back before the deadline expires.
- The consumer or a business acting as a consumer is liable for any decrease in the value of the Product resulting from its use in a manner that goes beyond what is necessary to ascertain the nature, characteristics, and functioning of the Product, unless the Seller has failed to inform the Consumer or a business operating as a consumer of the method and deadline for exercising the right of withdrawal and the model withdrawal form. In order to ascertain the nature, characteristics, and functioning of the Products, the Consumer or business with consumer rights should handle and inspect the Products only in the same manner as they would in a physical store.
- Subject to sections 5 and 6 of this chapter, the Seller shall refund all payments made by the Consumer in connection with the Sales Agreement from which the Consumer is withdrawing, using the same payment method used by the Consumer, unless the Consumer has expressly agreed to a different method of refund that does not entail any costs for the Consumer.
- If the Consumer has chosen a delivery method for the Product other than the cheapest standard delivery method offered by the Store, the Seller is not obligated to reimburse the Consumer for any additional costs incurred.
- A consumer who withdraws from the Sales Agreement in accordance with Section 1 of this chapter is responsible only for the costs of returning the Product to the Seller, unless the customer uses one of the free return options available through szybkiezwroty.pl or the Inpost cashless return service.
- If the Seller has not offered to pick up the Product from the Consumer, the Seller may withhold the refund of payments received from the Consumer until the Product is returned or the Consumer provides proof of its return, whichever occurs first.
- The 30-day period during which the consumer may withdraw from the contract begins:
- for a contract under which the Seller delivers the Product and is obligated to transfer ownership of it—from the date on which the Consumer or a business acting as a consumer (or a third party designated by them, other than the carrier) took possession of the Product,
- for a contract involving the regular delivery of a Product for a specified period—from the date the first Product is taken into possession,
- for other contracts – from the date the contract is entered into.
Exceptions to the right of withdrawal
- The Consumer does not have the right to withdraw from a distance contract in the cases specified in Article 38 of the Consumer Rights Act, in particular in the following types of contracts:
- where the subject of the transaction is a non-prefabricated item, manufactured according to the Consumer’s specifications or
- intended to meet the Consumer’s individual needs, where the subject of the transaction is an item delivered in sealed packaging that cannot be returned once opened for hygiene reasons, w
- here the subject of the transaction consists of items that spoil quickly or have a short shelf life,
- where the subject of the transaction consists of items that, due to their nature, become inseparably combined with other items after delivery.
- Both the Seller and the Customer (Consumer) have the right to withdraw from the Sales Agreement if the other party fails to fulfill its obligation within a strictly specified time limit.
Additional exemptions regarding weapons, ammunition, and licensed products
- Neither the consumer nor a business acting as a consumer has the right to cancel the contract in the case of a purchase of:
- firearms ,
- essential parts of firearms and ammunition, goods intended for military or police use,
- equipment requiring a valid permit or a corresponding entry in the registry, and
- products that have been registered in the firearms and ammunition registry under the purchaser’s name.
- This stems from the obligation to keep records of sales and the prohibition on re-selling such goods after they have been delivered to the customer, in accordance with the provisions of the Act of May 21, 1999, on Weapons and Ammunition, and the Act of June 13, 2019, on conducting business activities in the field of manufacturing and trading in explosives, weapons, ammunition, and products and technology intended for military or police use.
- The right of withdrawal also does not apply if sealed packages containing chemicals, preservatives, or pyrotechnic products (e.g., gun cleaning solutions, lubricants, blank cartridges) have been opened, if this could affect their functionality or safety.
XII. INTELLECTUAL PROPERTY
- All content published on the website at https://infov.eu is protected by copyright and—subject to Section 12 of Chapter I and elements used under license, transfer of copyright, or fair use—is the property of INFOV Spółka z ograniczoną odpowiedzialnością, KRS number: 0000621574, Tax ID: 7123313875, REGON: 364635788, Aleja Krakowska 9, 05-090 Sękocin Nowy, Poland.
- The Service Recipient bears full liability for any damage caused to the Service Provider resulting from the use of any content from the website https://infov.eu without the Service Provider’s consent.
- Subject to Sections 4 and 5 of this chapter, any use by anyone, without the express written consent of the Service Provider, of any element constituting the content of the website https://infov.eu, constitutes a copyright infringement and results in civil and criminal liability.
- Customers may use the works and databases contained on the Store’s website only within the scope of fair use defined by the provisions of the Act of February 4, 1994 on Copyright and Related Rights and the Act of July 27, 2001 on the Protection of Databases.
- In particular, except in cases specified by law, commercial copying, reproduction, transmission, distribution, or storage of part or all of the content of the website https://infov.eu without the prior written consent of the Service Provider is prohibited, unless the Terms and Conditions state otherwise.
- The Service Provider grants the Customer a non-exclusive, non-transferable, royalty-free license to use the copyrights to materials contained on the Store’s website solely for the purpose of reviewing the Product offer, concluding a Sales Agreement, or using electronic services such as the Newsletter or Customer Account.
Additional provisions regarding specialized content
- Materials concerning firearms, ammunition, optical, night vision, thermal imaging, and tactical technologies, as well as other products subject to regulations on trade in goods intended for military or police use, are informational and educational in nature. Their presentation on the website https://inarms.pl does not constitute encouragement to use firearms in a manner inconsistent with the law.
- Further processing, modification, copying, or public sharing of photographs, videos, and descriptions concerning equipment intended for military or police use is prohibited without the express consent of the Service Provider or the manufacturer of the equipment.
- All trademarks, logos, and manufacturer designations (including Pulsar, Hikmicro, Holosun, Delta Optical, Beretta, Sellier & Bellot, and others) used on the store’s website https://inarms.pl are used solely for identification and informational purposes. Rights to these marks remain the property of the respective entities.
- Service Recipients are prohibited from publishing materials (photographs, videos, descriptions) on the website depicting the use of firearms, ammunition, or tactical equipment in a manner inconsistent with legal regulations, safety principles, or good practices.
Licenses for user-submitted content
- By submitting a photograph with a description with the intention of having it published on the website https://inarms.pl, the Service Recipient grants the Service Provider a non-exclusive, royalty-free license to use the copyrights to the photograph, in accordance with the following terms:
- The license authorizes the Store to use the photograph for an indefinite period on the Store’s website and on social media platforms operated by the Service Provider (e.g., Facebook, Instagram).
- The license covers the following fields of exploitation: recording and reproducing the photograph by any technique, storing in computer memory, public sharing, broadcasting, and distribution on the Internet.
- The license is valid worldwide.
- The Service Recipient consents to the Store modifying the photograph (e.g., cropping, resizing, adapting to the website’s technical requirements), as well as combining the photograph with other promotional or informational materials.
- The Service Recipient declares that:
- they are the sole creator of the submitted photograph and hold full copyright to it,
- publication does not violate the rights of third parties or the personal rights of individuals depicted in the photograph,
- individuals visible in the photographs, whose consent is required, have given consent for publication,
- upon the Service Provider’s request, they will provide documents confirming the legal status of the photograph.
- By submitting a photograph or other content to the Store, the Service Recipient bears full liability for any infringement of copyrights, related rights, or personal rights of third parties, and undertakes to release the Store from any liability in the event of third-party claims.
XIII. PROVISIONS CONCERNING BUSINESS CUSTOMERS (B2B)
- This chapter contains provisions applicable exclusively to Customers who are not Consumers, including entrepreneurs and institutions making purchases as part of their business or statutory activities.
- The Seller has the right to withdraw from a Sales Agreement concluded with a Customer who is not a Consumer within 14 business days from the date of its conclusion. Withdrawal from the Sales Agreement in this case may occur without stating a reason and does not give rise to any claims by the Customer who is not a Consumer against the Seller.
- The Seller has the right to limit the available payment methods for Customers who are not Consumers, including requiring advance payment of part or all of the sale price, regardless of the payment method selected by the Customer and the fact that a Sales Agreement has been concluded.
- Benefits and burdens associated with the Product, as well as the risk of accidental loss or damage to the Product, pass to the Customer who is not a Consumer at the moment the Seller delivers the Product to the carrier. In such cases, the Seller is not liable for loss, shortage, or damage to the Product occurring from the moment the Product is accepted for transport until it is delivered to the Customer, nor for delays in shipment.
- In the event the Product is sent to the Customer via a carrier, the Customer who is not a Consumer is obligated to inspect the shipment at the time and in the manner customary for shipments of this type. If they determine that loss or damage to the Product occurred during transport, they are required to take all necessary steps to establish the carrier’s liability.
- The Service Provider may terminate the agreement for the provision of an Electronic Service with immediate effect and without stating reasons by sending a termination notice to the Service Recipient who is not a Consumer.
Additional provisions regarding the sale of licensed products to business customers
- In the case of the sale of firearms, ammunition, essential firearm parts, or goods intended for military or police use, the Customer who is a business entity is required to present to the Seller before concluding the agreement:
- a valid license or permit to conduct business in the field of trade or use of firearms and ammunition,
- company registration documents, confirming authorization to make such purchases,
- power of attorney for the person collecting the goods (if collection is made on behalf of the entity).
- The sale of products listed in Section 7 is conducted in accordance with the provisions of:
- the Act of May 21, 1999 on Firearms and Ammunition,
- the Act of June 13, 2019 on Conducting Business Activities in the Field of Manufacturing and Trade of Explosives, Firearms, Ammunition, and Products and Technology Intended for Military or Police Use,
- and applicable implementing regulations.
- The sale and delivery of firearms and ammunition to business customers is conducted exclusively in the form of personal collection at the Seller’s premises, by a person authorized to represent the purchaser or a designated employee, after presenting the appropriate documents and confirming in the firearms and ammunition trade register.
- The Seller is not liable for the manner of further use of licensed products purchased by the business customer. The B2B Customer is obligated to store, use, and transfer them in accordance with legal regulations and the conditions of the license held.
- A business customer purchasing optical, night vision, thermal imaging, or tactical equipment is liable for its lawful use, particularly in accordance with the provisions of the Hunting Law Act and the Firearms and Ammunition Act, if such equipment may be used in conjunction with firearms.
- In the event of refusal to present the required documents or doubts regarding the authenticity of the presented authorizations, the Seller has the right to refuse to fulfill the order, withhold delivery of the product, or withdraw from the agreement without incurring any liability for damages to the Customer.
- The B2B Customer is obligated to immediately inform the Seller of the loss or revocation of a license, permit, or other document authorizing possession and trade of firearms, ammunition, or specialized equipment.
XIV. PROVISIONS CONCERNING ENTREPRENEURS WITH CONSUMER RIGHTS
- An entrepreneur conducting sole proprietorship business (this chapter does not apply to commercial companies) is covered by the protection provided by the Act of May 30, 2014 on Consumer Rights, provided that the agreement they conclude with the Seller is directly related to their business activity, but the content of this agreement indicates that it does not have a professional character for them, resulting in particular from the subject of their business activity.
- The person conducting business activity referred to in Section 1 of this chapter is covered by protection exclusively in the scope of:
a) unfair contract terms—so-called abusive clauses,
b) liability under warranty for physical and legal defects of the Product, in accordance with Chapter X of the Terms and Conditions,
c) the right to withdraw from a distance contract, in accordance with Chapter XI of the Terms and Conditions,
d) rules concerning agreements for the supply of digital content or digital services. - The entrepreneur referred to in Section 1 of this chapter loses entitlements under consumer protection if the Sales Agreement they concluded with the Seller has a professional character. Professional character is verified based on the entrepreneur’s entry in the Central Register and Information on Business Activity (CEIDG), particularly the Polish Classification of Activities (PKD) codes indicated therein.
- Entrepreneurs referred to in Section 1 of this chapter are not covered by institutional protection provided to Consumers by district consumer rights advocates or by the President of the Office of Competition and Consumer Protection (UOKiK).
Additional provisions regarding the sale of firearms, ammunition, and licensed products
- The protection provided in this chapter does not apply to sales agreements for licensed products, in particular:
- firearms, essential firearm parts, and ammunition,
- goods intended for military or police use,
- devices or accessories requiring a permit for trade or possession (e.g., suppressors, thermal sights mounted on firearms).
- This is due to the fact that the sale of the products listed above is conducted in accordance with special regulations, including:
- the Act of May 21, 1999 on Firearms and Ammunition,
- the Act of June 13, 2019 on Conducting Business Activities in the Field of Manufacturing and Trade of Explosives, Firearms, Ammunition, and Products and Technology Intended for Military or Police Use,
and is not subject to standard provisions on withdrawal from agreements provided in the Consumer Rights Act.
- An entrepreneur with consumer rights making a purchase of products listed in Section 5 is obligated to:
- present the required documents (permit, certificate, service ID, etc.),
- collect the product in person at the Seller’s physical store,
- confirm collection in the firearms and ammunition trade register.
- The right to withdraw from the agreement referred to in Chapter XI does not apply to entrepreneurs with consumer rights with respect to the sale of licensed products or individually marked products (e.g., firearms with an assigned serial number).
- In the case of non-licensed products (e.g., daytime optics, night vision devices, thermal imagers, tactical equipment, clothing, accessories), entrepreneurs with consumer rights enjoy protection on the general terms provided for Consumers.
- XV. FINAL PROVISIONS
- Agreements concluded through the Store are concluded in accordance with Polish law.
The choice of Polish law does not result in depriving the Consumer of a higher level of protection than that which would be provided by the law applicable in their country of origin. - In the event of inconsistency between any part of the Terms and Conditions and applicable law, the relevant provisions of Polish law shall apply in place of the contested provision of the Terms and Conditions.
- All disputes arising from Sales Agreements between the Store and Customers shall be resolved primarily through negotiation, with the intention of reaching an amicable settlement.
However, if this is not possible or is unsatisfactory for either party, disputes shall be resolved by the competent common court, in accordance with Section 4 of this chapter.
Judicial dispute resolution
- Any disputes arising between the Service Provider and a Customer who is a Consumer shall be submitted to courts with jurisdiction in accordance with the provisions of the Code of Civil Procedure of November 17, 1964 (Journal of Laws No. 43, item 296, as amended).
- Any disputes arising between the Service Provider and a Customer who is not a Consumer shall be submitted to the court with jurisdiction based on the Service Provider’s registered office, i.e., in Sękocin Nowy, Poland.
- In the case of disputes arising from sales agreements for firearms, ammunition, essential firearm parts, or products intended for military or police use, the provisions of special acts also apply, including:
- the Act of May 21, 1999 on Firearms and Ammunition,
- the Act of June 13, 2019 on Conducting Business Activities in the Field of Manufacturing and Trade of Explosives, Firearms, Ammunition, and Products and Technology Intended for Military or Police Use,
- and applicable implementing regulations.
Disputes concerning these goods may be heard exclusively by courts with local jurisdiction over the Seller’s registered office.
Out-of-court dispute resolution
- A Customer who is a Consumer has the right to use out-of-court dispute resolution methods, in particular by:
- submitting, after completion of the complaint procedure, an application to initiate mediation or an application for the case to be heard by an arbitration court (the application can be downloaded from: www.uokik.gov.pl/download.php?plik=6223),
- using the assistance of Permanent Consumer Arbitration Courts operating at Provincial Inspectorates of the Trade Inspection (list: www.uokik.gov.pl/wazne_adresy.php#faq596),
- using free assistance from a district or municipal consumer rights advocate or a social organization whose purpose is to protect consumer rights.
- A Consumer may also file a complaint through the ODR (Online Dispute Resolution) platform, available at: https://ec.europa.eu/consumers/odr.
- Out-of-court pursuit of claims after completion of the complaint procedure is free of charge.
Final provisions regarding licensed sales
- In the case of the sale of firearms, ammunition, or other products requiring a license, the Seller:
- is obligated to archive purchase documents and copies of permits for the period specified by special regulations,
- reserves the right to refuse to disclose any data concerning such transactions to third parties, except in cases provided by law,
- maintains sales records in accordance with the statutory and control requirements of the competent authorities (including the Police and the Ministry of Internal Affairs and Administration).
- Sales agreements for firearms and ammunition are concluded exclusively in Polish, in written form, and with the obligation to confirm the identity and authorizations of the purchaser.
- All sales documents and confirmations of collection of licensed products constitute part of the trade register and are stored in a manner preventing access by unauthorized persons.
